Here is your essay on Judicial Precedent: Judicial Precedent is another important source of law, it is an independent source of law, where there are no legislations on the particular point in statute Books, and Judicial Precedent works great. Judicial precedent has been accepted as one of the important sources of law in most of the legal systems. According to Salmond, the doctrine of precedent has two meanings, namely (1) in a loose sense precedent includes merely reported case-law which may be cited and follows by the court, (2) in its strict sense, precedent means that case-law which not only has a great binding authority. There are variety of different views about the nature of judicial precedent. According to Jermy Bentham, Precedent is a judge-made Law while Austine calls it as judiciary’s law; Keeton holds precedents as those judicial pronouncements of the court which carry with them certain authority having a binding force. In simple words precedent means judge-made decisions which are used in further cases. A judicial precedent is purely constitutive in nature and never abrogative. The judges are not at liberty to substitute their own views where there is a settled principle of law. They can only fill in the gaps in the legal system and so we can say that precedent means a case decided previously. Or precedent is any set pattern upon which future conduct may be based. State of Punjab, AIR 1963 SC 151 clarified that what is binding is ratio decidendi, that is, the principle of law applicable to the legal problems disclosed by the facts of the case before the court, this makes clear that the obiter dicta of the Supreme Court is not binding for the lower court. State of Maharashtra has held that even the obiter dicta of the Supreme Court is binding upon the subordinate courts. Judicial precedent is a decision by a competent court of justice upon a disputed point of view which becomes, not merely a guide but an authority to be followed by all courts of co-ordinate or inferior jurisdiction and administrating the same system until it has been overruled by a court of superior jurisdiction or by a statute of superior authority, e.g., an Act of Parliament. The decision of High Court is also bound on lower court is also bound on Lower Court but the decision of High Court of one state is not bound on High Court of other state.

Artists of western Asia are heirs to the first civilizations known to man and their landscape is rich with examples of art, from the first human-form statues to Islamic and modern art. In the twentieth century, artists borrowed elements from their respective ancient patrimonies in an effort to create a national and regional cultural identity. Several artists’ groups formed between the 1930s and ’60s adopted European artistic modes of expression to produce works inspired by their heritage and by a rapidly disappearing landscape victim to urban migration and industrialization. This trend was most evident in Iraq, Jordan, and, to a limited extent, Israel and the Arabian Peninsula. Each country had its unique stages of development characterizing its artistic production, forging a synthesis of ancient western Asian cultures and Western styles. This unique synthesis is represented in the work of the Baghdad Modern Art Group in Iraq, and the Jewish Bezalel school of the early 1920s in Jerusalem. Jewish artists, traumatized by the Holocaust, rejected their European roots and turned to “Canaanite” myths and symbols in their quest for a national Hebrew identity. At the dawn of the twentieth century, life in many villages of western Asia had much in common with ancient life.

Afro-textured hair is the natural hair texture of certain populations in Africa, the African diaspora, Oceania and Asia. Each strand of this hair type grows in a tiny, spring-like helix shape. The overall effect is such that, compared to straight, wavy or curly hair, In many post-Columbian, Western societies, adjectives such as "wooly", "kinky", "nappy", or "spiralled" have frequently been used to describe natural afro-textured hair. More recently, however, it has become common in some circles to apply numerical grading systems to human hair types. One popular version of these systems classifies afro-textured hair as 'type 4' (straight hair is type 1, wavy type 2, and curly is type 3, with the letters A, B, and C used to indicate the degree of coil variation within each type), with the subcategory of type 4C being most exemplary of this hair type (Walker, 1997). However, afro-textured hair is often difficult to categorize because of the many different variations among individuals. Those variations include pattern (mainly tight coils), pattern size (watch spring to chalk), density (sparse to dense), strand diameter (fine, medium, coarse), and feel (cottony, wooly, spongy). Different ethnic groups have observable differences in the structure, density, and growth rate of hair.

Indians [], in South and Southeast Asia and East Africa respectively, interacted across the Indian Ocean highway and all shaped Islam in their own ways. Only a small number of people actually voyaged overseas physically, but they were all influenced by the ideas brought in by those who did. The history of Islamic law in the Indian Ocean world tells us the story of this general pattern of mobility across communities, doctrines, texts, sources, places and periods. In this essay, I explore the Africans who worked in South and Southeast Asia as judges, jurists, scholars and preachers in premodern period. The Arabs and Persians played an inevitable role in circulating certain basic ideas of Islam, but they did not ‘export’ Islamic law to ‘the peripheries’ as many studies of Islam in the Indian Ocean littoral have illustrated by ignoring the African and Asian contributions.
